We aim to ensure that you feel safe on our website, so your privacy and the protection of your personal rights are important to us. You can trust that your data will be processed transparently and fairly, and we will make every effort to handle your data carefully and responsibly.

This Privacy Policy sets out the rules for the processing and protection of personal data provided by Users in connection with their use of services through the www.intelka.net website. It fully complies with the strict requirements of the Polish  Data Protection Act and the requirements of the General Data Protection Regulation (GDPR).

1.3. Website - a website run by the Seller, available at the following address: www.intelka.net through which the Customer / User can obtain information about the Goods and their availability, as well as purchase the Goods or order a service.
1.4. User - a physical person entering the website / pages of the website and online store or using the services or functionalities described in this Privacy and Cookies Policy.
1.5. Customer - a physical person with full legal capacity, a physical person who is a Consumer, a legal person or an organizational unit without legal personality, to which the law grants legal capacity, which concludes a Distance Sale Agreement with the Seller.
1.6. Device Information - information about User web browser, IP address, time zone and location, cookies that are installed on User's device, individual web pages or products that are viewed by User, what websites or search terms referred User to the Website, and information about how User interact with the Website.
1.7. Order Information - User information, that is name, surname, billing address, shipping address, payment information (including credit card numbers [[INSERT ANY OTHER PAYMENT TYPES ACCEPTED]]), email address, phone number, history and details of the transactions (including what, when and in which store product was bought, used discount codes, etc.), age range, signature (e.g. confirming the receipt of goods), complaints and opinions.

2. THE SCOPE OF THE PERSONAL DATA PROCESSING

2.1. We are automatically processing and collecting Your personal data information to the extent necessary to ensure the functioning of the website, it’s content and services presented by us, like the registration process on our website, logging in to an existing customer account or ordering the products, making purchases and fulfill all legal obligations incumbent on us.

2.2. Your personal data is collected and used only with your consent. The exception to this rule are situations in which prior consent is not possible due to the given circumstances, and the processing of data is permitted by law.

2.3. We process the following data in particular: Device Information, Order Information and in order to be able to answer your questions or reported problems as well as possible, we also process information about the content of your communication with us, including additional information that you may have included in your e-mail correspondence or that you may have provided during a telephone conversation with our representative. We also always collect information about the source of your data.

Therefore, we take technical and organizational measures to ensure the protection of your data stored by us, in order to effectively prevent their loss and misuse by third parties. Our employees involved in the processing of personal data are bound, in particular, by a confidentiality obligation and must comply with it.

3. GOALS, LAWS AND TIME OF THE PRIVACY DATA PROCESSING

3.1. We collect, process and use your personal data for the following purposes:
      -Running online shop and website www.intelka.net and ensuring its functionality according to Regulations,
      -Establishment and performance of sales and services contracts provided via website,
      -Provision of newsletters,
      -Marketing activities,
      -Customer service and customer support,
      -Provision of broadcast media services, e.g. to process orders for goods and services we offer over the                                                       Internet.

3.2. Your personal data may be processed on the basis of the following legal principles:
Art. 6, § 1a) The GDPR is the legal basis for processing activities for which we obtain your consent for a given processing purpose,
Art. 6, § 1b) The GDPR says that personal data may be processed for the performance of a contract, e.g. when purchasing a product. The same applies to any processing activities necessary to carry out pre-contractual activities, such as handling inquiries about products or services.
Art. 6, § 1c) The GDPR applies where we have a legal obligation to process personal data, for example to fulfill tax obligations.
Art. 6, § 1d) The GDPR says that personal data may be processed in order to protect the vital interests of your person or another natural person.
Art. 6, § 1f) The GDPR applies to our legitimate interests, for example when hiring service providers to fulfill orders (e.g. delivery services), when completing statistical surveys and performing statistical analyzes, when trying to log in or ensure security on the website.

3.3. We process and store your personal data only for as long as is necessary to fulfill the purpose of their storage or as long as we are required to do so by law or regulations.

3.3.1. For the purposes of sales, as well as delivery and assembly services, we store the data for the duration of the contract. Thanks to the storage of your data, we can fulfill the contract concluded with you, including in particular delivering the order to you.
3.3.2. If you register in our online store we store your data for the period for which you are registered. Thanks to the storage of your data, we can provide you with access to your account in our online store. 
3.3.3. If you asked us a question and you are not a registered user of the online store, we store your data for the time necessary to provide the necessary explanations and answers. By storing your data, we can answer your question in the best possible way.
3.3.4. We process data about the way you use our store (obtained via cookies) for the period of validity of the cookie file or until you delete it.

4. COOKIES

We use cookies, web analysis services and social media plugins on our website, for which there is a separate Cookie Privacy Policy.

5. ADMINISTRATOR ACTIVITIES REGARDING OUR PRODUCTS, SERVICES AND SPECIAL OFFERS

5.1. On the website, the Data Administrator may post marketing information about its products or services. Displaying this content is made by the Data Administrator in accordance with art. 6 §1 a) of GDPR, i.e. in accordance with the legitimate interest of the Data Administrator consisting in the publication of content related to the services provided and the content of promotional campaigns in which the Data Administrator is involved. At the same time, this action does not violate the rights and freedoms of Customers / Users, as they  expect to receive the content or even it is their direct purpose of visiting the website.

5.2. We use your data to send the information you request regarding our products, services and other special offers to the e-mail address provided by you. The above will only take place with your prior consent or if it is permitted by law. Granting consent to such transmission is governed by art. 6 §1 a) and art. 7 of GDPR.

5.3. When registering at our website, you create an account, we will store your e-mail address along with all other details provided by you so that we can provide you with information about our products and services. 

5.4. You can subscribe to a free newsletter on our website. When registering for the newsletter, the data from the data form will be sent to us, i.e. your e-mail address. 

5.5. If you purchase products or services on our website, we may send you information about our own, similar products and services to the e-mail address provided by you, even without your consent.

5.6. We may also use your data to send you information about our products, services and special offers by post.

5.7. You can also unsubscribe to stop receiving e-mails and/or newsletters , i.e. withdraw your consent with effect for the future, for which purpose an appropriate unsubscribe link is included in every e-mail and newsletter. You will then be asked to confirm your unsubscription on our website. You can also contact us to withdraw your consent at any time under the below e-mail:

The unsubscription can be doen with the exception described in point 5.8. of this Privacy Policies.

5.8. It is not possible to unsubscribe from receiving certain informational messages required for the performance of contracts and for the operation of our website, including service-related e-mails (e.g. registration confirmations, customer service information) or information about purchases (e.g. order confirmations, contract documents relating to payment processing). You will receive these notifications according to the contact details provided.

6. RECIPIENTS OF USER DATA

6.1. The data administrator discloses the personal data of Users and Customers only to processing entities under the concluded contracts for entrusting the processing of personal data for the purpose of providing services by the Data Administrator, e.g. hosting and servicing the Website, IT services, marketing and Public Relations services, Sales, Shipment.

6.2. When transferring your personal data, we ensure that the level of security is always the highest possible, therefore your data is only transferred to carefully selected and related contractual obligations to service and partner companies. We transfer your data only to entities located within the European Economic Area and thus subject to strict EU data protection regulations, or to one that is bound by an appropriate security standard. Data transfer to third countries is not currently being practiced or planned.

6.3. In connection with the services and products offered on our website, we cooperate with various contractor companies responsible for certain product groups. If you order products from these contractors, we will provide them with the data you provided during registration and any data that is needed to continue on delivering the contract. 

6.4. To operate and optimize our website and to fulfill contracts, we engage various service companies to act on our behalf, e.g. to provide central IT services, to host our website, to process payments and ship products, to install equipment or to deliver newsletters. We provide service partners with the information required for a specific purpose (e.g. name, address). Some of these companies act on our behalf in connection with the processing and fulfillment of orders and are therefore only allowed to use the data provided in accordance with our instructions. In this case, we are legally responsible for ensuring that appropriate measures are taken to ensure data security. Therefore, we agree with these entities on specific data security measures and regularly monitor these solutions.

6.5. With regard to the payment for the ordered goods, the data is transferred to the payment processor specified in the order or to the financing bank. We do not collect or store payment information such as credit card numbers or account details. They are exclusively and directly sent to the respective payment processor.

6.6. Finally, we may transmit your data to third parties or government bodies under current data protection legislation if we are legally required to do so (e.g. on the basis of an order of a public authority or court of law) or if we are entitled to do so (e.g. because it is necessary for the investigation of criminal activity or to assert and enforce our rights and interests).

7.2. In order to use the above-mentioned rights, the data subject should contact the Data Administrator using the contact details provided in point 9 of this Privacy Policy and inform him of which right and to what extent he wants to use it. This use of the rights is free of charge, not including any costs that the Data Subject will be charged by contact canal, e.g. telecommunications provider for transmitting the message.

8. PRIVACY POLICY CHANGES

8.1. The privacy and cookie policy may be supplemented or updated in accordance with the current needs of the Administrator in order to provide current and reliable information to Customers and Users.
